Luque was criminally charged with sexually abusing two boys at Our Lady of Guadalupe in San Bernardino and at San Salvador in Colton during the 1960s. The charges against Fr. Luque were eventually dropped due to a United States Supreme Court ruling that changed the law surrounding the statute of limitations. Fr. Luque has been named in at least one civil lawsuit. Fr. Luque was included in the Diocese of San Diego’s list of priests where the Diocese has received a credible allegation involving sexual abuse of a minor. His whereabouts and whether he had access to children from approximately 2004 until his death in 2013 are unknown.
